Former Athletic Director seeks to get Killebrew Under Oath over Firing & NCAA Scandal

Former TAMUCC Athletic Director Brian Teter is suing President and Bold Future co-leader Flavius Killebrew asserting that he lied to NCAA officials in order to put the blame on Teter for violations of NCAA rules. Teter also alleges Killebrew unlawfully fired him over unrelated issues, Teter says are retaliatory. That suit could put Killebrew under oath about his NCAA Testimony.

Teter was found guilty by the NCAA of one of three charges, that he should have reported the NCAA violations no matter what the University did. Teter found out about the violations two weeks after he started and went to Killebrew to find out how the President wanted to proceed. Teter and two other athletic officials at the University reported the same story, Killebrew refused to commit to a course of action. Killebrew told the others to leave and that is where the contention comes in.

Teter says Killebrew wouldn’t make a decision and when Teter finally said lets wait an see, that Killebrew went along with it. Later when the University was forced to reveal the violations, Killebrew blamed Teter for the whole thing. The NCAA did not accept that and found the University guilty of a “lack of institutional control” and gave them multiple sanctions which the University is appealing.

The committee said an “atmosphere of noncompliance” was pervasive and said “violations were approached with a desire to ‘sweep them under the rug,’” the report went on to quote from Killebrew’s testimony to make its point:

Committee Member: And one of the things I read in the institutions’ response was that that you never asked (former director of athletic) “did you report it?” You just said “ is there anything I need to know that is wrong down in the program” And I was very curious why you didn’t ever specifically follow up with (the former athletics director) on what he had decided on this specific case. Presumably, you had not had athletic director coming to you very often saying, since you were just reinstating this program, even we may have a major violation?
President: That’s not exactly accurate. I did ask several weeks later if they had followed up on it and was told that it had been handled.
Committee Member: And did you ask what that handling was?
President: Unfortunately I did not.
Committee Member: Why not?
President: Again, I felt like had confidence in my new athletic director. He said in the private meeting with me that he was going to do the right thing.
Committee member: Didn’t you want to know if your institution had made a report of a violation to the NCAA. He said he handled it. That could have meant that he filed the report, right?
President: There was a great deal going on at that time that I am sure I was distracted by. We had a number of other discussions going on, and clearly I should have asked for a report and I didn’t.
